ARKANSAS HOT CHECK LAWS
A Brief Summary

Any check that is written in Arkansas when the writer knows or should know that the account has insufficient funds to cover the check at the time it is written is a “Hot Check.”

If the amount of the check is for under $200.00 it is a Misdemeanor. If the amount of the check is over $200 or there are multiple checks totaling more than $500.00 in a 90 day period then the amount may be a Felony.

A Hot Check Misdemeanor is punishable by up to one year in the county jail and fine not exceeding $500.00.

A Hot Check Felony where the check or checks total for under $2500.00 is a class “C” felony punishable by 3-10 years in prison and a fine up to $10,000.

A Hot Check Felony where the check or checks total over $2500.00 is a class “B” felony punishable by 5-20 years in prison and a fine of up to $15,000.
